Payouts

Binding Arbitration

Jury Trial Waiver

Small Claims Exception

Either party may bring an individual action in a small claims court when the dispute falls within that court’s jurisdiction.

Injunctive Relief

Subject to applicable law and the Amino Hood Privacy Policy, you grant Amino Hood a worldwide, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable right to collect, receive, store, organize, use, process, analyze, combine, disclose, share, transfer, license, commercialize, and otherwise lawfully use Your Information.

These activities may be performed for purposes including operating and maintaining the Website, processing and fulfilling orders, processing payments, managing accounts, providing customer support, detecting and preventing fraud, protecting Website security, improving Website performance, personalizing content and services, conducting analytics, developing products and services, complying with legal and regulatory obligations, enforcing these Terms, sending transactional and service communications, sending marketing and promotional communications, measuring advertising performance, conducting market research, forecasting customer or business activity, customer segmentation, risk scoring, creating aggregated or derived data, and training, testing, evaluating, and improving statistical, analytical, machine-learning, and artificial-intelligence systems.

Amino Hood may create aggregated, de-identified, anonymized, pseudonymized, or otherwise derived data sets. To the extent permitted by law, Amino Hood may own, use, disclose, license, transfer, sell, or commercialize those data sets without further payment or obligation to you, provided that such data is handled in accordance with applicable law.

Amino Hood may share Your Information with payment processors, e-commerce platforms, hosting providers, shipping carriers, warehousing and fulfillment providers, customer-support providers, analytics providers, advertising and marketing partners, fraud-prevention and security providers, technology service providers, professional advisors, accountants, auditors, attorneys, insurers, government agencies, regulatory authorities, affiliates, successors and assigns, and other parties acting on Amino Hood’s behalf or for the purposes described in these Terms.

For purposes of these Terms, “Affiliates” means any present or future entity, company, brand, product line, subsidiary, parent, sister company, joint venture, successor, or business that directly or indirectly controls, is controlled by, is under common ownership with, or is under common management with Amino Hood, regardless of its legal form, jurisdiction, industry, or operating name.

To the extent permitted by applicable law, sharing information within a commonly controlled enterprise for the purposes described in these Terms may be treated as an internal business use rather than a sale of personal information.

Amino Hood may transfer or assign Your Information and related rights or obligations to an acquirer, investor, lender, successor, or other party in connection with a merger, acquisition, reorganization, financing, investment, sale of assets, change in control, bankruptcy, insolvency, corporate restructuring, or similar transaction or proceeding.

You expressly consent to receive marketing and promotional communications from Amino Hood and, where permitted by law, its Affiliates, successors, and assigns through channels for which you have provided contact information, including email, SMS or text message subject to Section 23, push notification, postal mail, in-app message, Website notification, and other available communication channels.

Consent to marketing communications is not a condition of purchase.

You may unsubscribe from marketing emails by using the unsubscribe link included in the message. You may unsubscribe from eligible text messages by replying STOP.

Unsubscribing from marketing communications does not prevent Amino Hood from sending order confirmations, shipping notifications, account notices, security messages, policy updates, customer-service communications, or other transactional and service-related messages.

Depending on your state of residence, you may have rights to know, access, correct, delete, obtain a portable copy, limit certain uses, opt out of certain sales or sharing, opt out of targeted advertising, appeal certain privacy decisions, or exercise other rights provided by applicable law.

Nothing in these Terms limits or waives any privacy right that applicable law does not permit you to waive.

The licenses, consents, permissions, and authorizations in this section survive termination of your account and these Terms to the extent permitted by law.

If any portion of this section is determined to be unenforceable in a jurisdiction, the remaining portions will continue to apply to the maximum extent permitted by law.

General

When you voluntarily opt in to an Amino Hood messaging program, Amino Hood may send an initial message confirming your enrollment.

By opting in, you agree to receive recurring automated marketing, promotional, transactional, and informational text messages from Amino Hood at the mobile telephone number you supplied or another number you later designate.

Messages may be sent using an automatic telephone dialing system or other automated technology where permitted by law.

Your consent to receive marketing text messages is not a condition of purchasing any product.

Message Frequency

Message frequency varies.

Additional messages may be sent based on your interactions with Amino Hood, your purchases, your account activity, your marketing preferences, product or catalog updates, promotional campaigns, and service-related events.

Amino Hood may increase or decrease message frequency at any time.

Amino Hood may also change the telephone number, short code, toll-free number, or alphanumeric sender used to send messages.

Message and Data Rates

Standard message and data rates charged by your mobile carrier may apply.

You are responsible for charges imposed by your carrier or service provider.

Questions about your mobile plan should be directed to your mobile carrier.

Carriers

Wireless carriers are not responsible for delayed, blocked, or undelivered messages.

Delivery is subject to effective transmission by your carrier and is not guaranteed by Amino Hood.

Cancellation

You may cancel participation in an eligible Amino Hood messaging program by replying STOP to a message or by using an unsubscribe link included in the message, when available.

After submitting a valid unsubscribe request, you may receive one final message confirming that you have been unsubscribed.

After confirmation, no additional marketing messages will be sent through that messaging program unless you enroll again.

To begin receiving messages again, you may complete the applicable opt-in process again.

Help and Support

For assistance concerning the messaging program, you may reply HELP to an eligible message where supported, follow a support or unsubscribe link included in the message, or email Amino Hood at admin@aminohood.com.

Transfer or Change of Telephone Number

Before changing your mobile telephone number, transferring it to another person, or relinquishing control of the number, you agree to unsubscribe from Amino Hood messages by replying STOP from the original number, using an unsubscribe link included in a message if available, or contacting Amino Hood at admin@aminohood.com and identifying the former number.

Providing notice before transferring a number is a condition of participation in the messaging program.

Changes to Messaging Terms

Amino Hood may modify, suspend, or terminate its messaging program at any time.

Amino Hood may also update these messaging terms at any time.

Continued enrollment after updated terms are posted constitutes acceptance of those changes.
